He was convicted in October of conspiracy to engage in the business of dealing firearms without a license.

As part of the scheme, Arao purchased the firearms — all Colt .38 super-caliber handguns — that were not available to the general public, but which could be legally purchased by law enforcement officers through Ronin Tactical Group, a federal firearms licensee that Arao owned.

I don't know of ANY police department or savvy individual police officer in the United States who would use a .38 Super now.   They ARE supposed to be good for target shooting, I think.

There is no semiauto handgun of any specific caliber in the civilized United States that is restricted to law enforcement only.  I see that this case was in Commiefornia, where the gun laws there are extremely stupid, and those guns were probably not on their "approved for sale to civilians" list, and most likely only because their magazine capacity exceeds Californication's arbitrary limit.

The man committed a "crime" that is perfectly legal in normal states, except for the selling to convicted felons and falsifying documents parts.   For that, there is NO excuse.

Hey, it's California, where people who commit VIOLENT CRIMES are allowed to walk. Hell, they don't even arrest major thieves!

As I read it, they were FEDERAL charges, not state charges, so no, they could not have done it in other states, and the state had nothing to do with the prosecution.

I also got lost why mentioning the .38 Super was included in the Fed legal procedure. That is the State of Cali decision not to include that specific Brand AND caliber in their approved list. Making it unavailable to the general public in Cali. Not your fault or did you have any input to include. Just an insignificant part of the main story. Sidebar, that round in any frame used to be a hot gun to get into Mexico as it was legal in Mexico because it’s not a military or police round. May still be, don’t know.

The round is available w other brand platforms in Cali. Colt just was recently not interested in submitting that combo for Cali approval.

People need to learn they don't have to answer ANY questions from a police officer.   If you are actually arrested, you must provide identification.

If you are stopped for a traffic violation, you must provide your D/L, registration, and proof of insurance, if the state requires insurance.

That's IT.   But for goodness' sake, do not argue vigorously about the ticket.  If the officer has his mind made up, just accept the ticket and contest it in court, not on the side of the road.  You won't win there.

"Where are you going?"  He has no right know. 

"Where are you coming from?"  He has no right to know.

"Do you have any weapons in the car?" He has no right to know.

But don't be rude or antagonistic.  Calmly explain you are exercising your right to not answer questions.
