Relying on recess appointments is a bad idea. Hell has officially frozen over….we agree on something. He should rely on regular order advise and consent for most of them. If too many senators up for re election in 26 feel uncomfortable voting for say a Kennedy or Gaetz then leadership of both houses should give them a pass by voluntarily going into a recess and go the recess appointment route with them. The president should not in any way force a recess if he can do it. He (Trump) may not get every appointment he wants. That’s the way it goes sometimes.

I was saying that the concept of a recess appointment existed in those days because travel was difficult and recesses weren't for days or weeks but months. Washington appointed Rutledge in August as an emergency fill-in because the Senate had recessed...for 5 months. Rutledge was promptly considered and rejected as soon as The Senate reconvened in December. So as I said, I get the idea of a recess appointment, but The Senate did not recess in order to dodge their responsibility back then as this current group of spineless Trump toadies are suggesting.

Most appointees will go through the normal senate advise and consent process. A recess is a last act not a first one. A recess appointment can only stay until the end of the then current congress. Then they seek confirmation or leave office. No one can be recess appointed twice in a row.

Then they seek confirmation or leave office. No one can be recess appointed twice in a row. There is no reason the Senate should dodge their responsibility. That they even talk about it demonstrates their spinelessness. If they want to be a rubber stamp, they should move to Russia and run for a seat in the Duma. Putin will welcome their presence and maybe cut them in on a piece of the action for their loyalty.
