The homeless crazy man threatened people in the subway car. He yelled that he didn't care if he went to prison but someone on the car was going to die. He then approached a young woman with a child. Penny subdued the lunatic. When police finally arrived they confirmed the crazy man still had a pulse but they refused to perform CPR because they feared the loony had some disease. Penny was not arrested at the time and voluntarily met with police and gave his statement. So Penny did not kill him but still got charged with manslaughter 10 days after the incident by the District Attorney after blacks rioted and threatened violence. So if you shoot me and I die of disease from the wound but not from the bullet. Did you kill me?
