 IS your Q "What is your problem with illegal aliens possessing a firearm?" meant to suggest that they, illegal aliens can legally possess a firearm based on the ruling handed down by US District Judge Sharon Johnson Coleman? Interesting stuff, if so. Is the GCA now invalid? Does Congress get involved? This follows case in '23 that said a man (not an illegal alien) convicted of a nonviolent crime can own a gun. I would guess if the non-violent crime was a felony he'd have to appeal and get a response in writing, the retail outlet denying the sale if he answered the background check honestly, to NICS. The bulk of federal law governing who can legally possess firearms in the U.S. is spelled out in 18 U.S.C. 922, established by the Gun Control Act of 1968 and amended by subsequent legislation. It lists groups of people who are not allowed to possess firearms, and the prohibitions still on the books today include several categories of non-citizens, according to an ATF spokesperson. Those prohibited include anyone who is an “illegal alien” along with anyone who has renounced U.S. citizenship, according to the law. Federal firearm regulations must be based on that law, Michael explained.

As an aside, ATF cannot change statutory prohibition categories.

Guidance flyers from ATF in 2020 point to those restrictions as well as clarifying that people lawfully in the U.S. on a nonimmigrant visa largely may not possess a firearm. Exceptions were made for use with a valid hunting license or permit, being an “official representative of a foreign government” that meets certain criteria or being “a foreign law enforcement officer of a friendly foreign government entering the United States on official law enforcement business.”

It is possible the claim stems from a misunderstanding of guidance the FBI issued in August 2023 that noted that refugees should be considered “immigrant aliens” when assessing eligibility. That distinction opens the door for firearm possession if certain criteria are met. But it doesn't refer to people in the country illegally.

But Coleman's apparent ruling doesn't address one key issue I didn't see noted in the cliff note version, that the illegal alien may in fact be a felon. Another prohibition. As I said interesting stuff. 

In any case, if an illegal tries to buy a firearm at a retail outlet, ruling or not, they will not be able to purchase one, absent a change from the ATF or w/o an appeal to NICS, w a response in writing. If for no other reason than he is a felon.

I did not know it was actually codified in GCA. After reading that, it seems cut and dry to me.
Now I am curious to read the decision, cuz 18USC922 is explicit.
