PUBLISHED UNITED STATES COURT OF APPEALS FOR THE FOURTH CIRCUIT ...ruled unconstitutional today.
18 y/o can join the military, pick up guns to defend the country, but not allowed to legally buy handguns for their legal uses? Yeah, that needs to be struck down.
No. 19-2250 TANNER HIRSCHFELD; NATALIA MARSHALL, Plaintiffs – Appellants, v. BUREAU OF ALCOHOL, FIREARMS, TOBACCO & EXPLOSIVES; MARVIN RICHARDSON, Acting Director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives; MERRICK B. GARLAND, Attorney General, Defendants – Appellees. ------------------------------- BRADY; GIFFORDS LAW CENTER TO PREVENT GUN VIOLENCE; EVERYTOWN FOR GUN SAFETY SUPPORT FUND, Amici Supporting Appellees. Appeal from the United States District Court for the Western District of Virginia, at Charlottesville. Glen E. Conrad, Senior District Judge. (3:18−cv−00103−GEC) Argued: October 30, 2020 Decided: July 13, 2021 Before AGEE, WYNN, and RICHARDSON, Circuit Judges. Vacated, reversed, and remanded by published opinion. Judge Richardson wrote the opinion, in which Judge Agee joined. Judge Wynn wrote a dissenting opinion
The entire decision is 141 pages, the Relevant verbiage is below:
But while Congress—or judges—may have struck a different balance long after ratification, that role is foreclosed to us by the balance that the Founders chose. We cannot now second-guess or undermine their choice. History makes clear that 18- to 20-year-olds were understood to fall under the Second Amendment’s protections. Those over 18 were universally required to be part of the militia near the ratification, proving that they were considered part of “the people” who enjoyed Second Amendment rights, and most other constitutional rights apply to this age group. And Congress may not restrict the rights of an entire group of law-abiding adults because a minuscule portion of that group commits a disproportionate amount of gun violence. Congress’s failure to connect handgun purchases from licensed dealers to youth gun violence only serves to highlight the law’s “unduly tenuous ‘fit’” with the government’s substantial interests. Craig, 429 U.S. at 202.
Eighteen- to twenty-year-olds have Second Amendment rights, and the challenged laws impermissibly burden those rights. As a result, we vacate the district court’s grant of the motion to dismiss, reverse the denial of summary judgment, and remand for further proceedings. VACATED, REVERSED, AND REMANDED

18 year olds can also vote.
That is frightening when you think they have grown up being brainwashed by lieberals. Just look at ll the little geniuses running around trying to dictate how the adults who control colleges should think and act.

Teens and young adults commit the most crimes, but how can they have every right in the constitution but one. In the end I'd err on the side of rights over fear, especially considering criminals aren't doing NICS checks.

Actually there is NO age limit mentioned in 2A at all. Nothing about sex, race, income, religion, or anything else, either.
Come to think of it, since Demoncrats think free health care is a right, then they should be handing out free guns, too.
We KNOW gun ownership is a right.

Any kid who can go to war should be allowed any right an adult gets. Period. I get the idea, but no...don't go there.

If you say it is OK for an 18 year old to vote, but not own a gun, you are practicing age discrimination. An 18 year old has the right to enter into a lawful contract, to be tried in criminal court as an adult, and a whole lot of other "ideas."

The 'idea' is that 18 yr olds make a shitload of bad decisions and things like guns and alcohol are sometimes the elements that cause some of those bad decisions to go south in a big, fat hurry. I get that. But sorry. I'm obviously old enough to own a gun if you draft me, put a gun in my hand and send me off to war.

So according to you, 18 year olds should NOT be voting, or trying to dictate what colleges allow on their campuses. And no, a GUN has never caused anyone to commit a crime or do something wrong. Unlike alcohol or drugs, a gun has no mind-altering capabilities.

Quite the opposite. There should be no discrepancy in the law for any statutory adult, and that includes guns, the draft, booze and voting. Now if you want to discuss if 18 yr olds should be statutory adults at all, that is, perhaps, a better discussion.

Now if you want to discuss if 18 yr olds should be statutory adults at all, that is, perhaps, a better discussion. We are getting there. NOW you need to realize that guns do not kill people --- people kill people. Yes. it is trite, but it is TRUE. Washington D.C. probably has the most strict gun laws anywhere. So why are criminals still shooting each other? What happened to those gun laws? Be honest and answer the question truthfully.
I have to err on the side of freedom. Many 18 year olds have not been raised to handle adulthood, even when they turn 25. Other 18 year olds are VERY mature. Therefore, I have to say that 18 year olds SHOULD BE statutory adults, and the ones who can't follow society's rules should be punished the same as a 40 year old.
Until lieberals stop mollycoddling criminals, the U.S. is going to remain being victims of the young hooligans.

Don't worry, wally will never say it but the logical leftist conclusion will be that the only way to stop the gun violence is to remove all the guns. Of course he knows and we know that that would only INCREASE the gun violence in THIS country unless a nazi type government is in place. I'm sure he'd like that so long as it was still called the democrat party.

No exceptions. No background checks, No firearms dealers. No paperwork. Outlaw all firearm ID numbers so that all guns are anonymous, anonymously owned and completely untrackable. In addition, all handheld firearms should be legal. If you can carry it, it should be legal. Guns don't kill anyone. Murderers can own kitchen knives. No law against that.. so why not guns?
