I don't have Trn's knowledge to look at Case Law or DB to draw from but it can be as I understand it. In United States law, depraved-heart murder, also known as depraved-indifference murder, is a type of murder where an individual acts with a "depraved indifference" to human life and where such act results in a death, despite that individual not explicitly intending to kill. I’d call that the Chappaquiddick statute. If I had my way. 😂😎 You are suggesting EK intended to kill the woman and drove off the bridge with 'depraved indifference'? Got any holograms to back that up? |

Apparently it does. On my planet, 'not explicitly intending to kill' means something like (to bring this back to the thread) loading a live round into prop gun on a movie set, (as opposed to explicitly intending to kill by just shooting someone). That live round isn't 'explicitly' going to kill anyone, but if intentionally loaded, is most definitely 'depraved indifference' to a LIKELY result. Not only did Kennedy kill her, but he failed to render aid or immediately summon help. That's THREE crimes right there. He totally avoided a fourth charge, DWI, by his delayed actions.

Untrue. Diving experts that assisted in recovering the car stated the car would have had an air bubble that would have enabled Mary Jo Kopechne to survive for as long as an hour. The coroner stated she had excessive amounts of water in her lungs. There were occupied houses nearby with outside lights still on. Why didn't Teddy try to call for help? She definitely survived the crash.
