It was his graceful way out of getting censured by his colleagues and getting the file closed. It is odd that the FBI or Florida police never charged Gaetz with any crime. But, as we've seen, Democrats need no facts to smear any Republican. Imagine the gall of Democrats for allowing Killer Teddy Kennedy to sit in judgement of anyone.

Seeing different thoughts from different sources. Some suggest the House rules may require him to go through another special election. A big question, does he want to return? By resigning he pretty much shut down the ethics report on him. Should he return I'm sure that comes out. May leak out anyway. Interesting times.
Article I, Section 2, Clause 4 of the Constitution says, “When vacancies happen in the Representation from any State, the Executive Authority thereof shall issue Writs of Election to fill such Vacancies.”I saw another interview with a US Rep today saying he resigned with Congress out of session. He thinks the Speaker cannot officially accept his resignation until the new Congress opens. Lee would have the choice to ignore the resignation and he'd be seated. Another argument is he resigned before the new session but was just elected to that session so he'd have to be seated and resign again. At this point I think the only thing certain is that it's uncertain how it proceeds. |

Not sure that his resignation now impacts this. If he were AG confirmed there would need to be a special election. I see nothing preventing him from joining congress as a new member with other incoming new members. He might lose seniority on committees and be a freshman member again though |
