Article I, Section 2, Clause 4 of the Constitution says, “When vacancies happen in the Representation from any State, the Executive Authority thereof shall issue Writs of Election to fill such Vacancies.”

I saw another interview with a US Rep today saying he resigned with Congress out of session. He thinks the Speaker cannot officially accept his resignation until the new Congress opens. Lee would have the choice to ignore the resignation and he'd be seated. Another argument is he resigned before the new session but was just elected to that session so he'd have to be seated and resign again. At this point I think the only thing certain is that it's uncertain how it proceeds.

Moot point now that Gaetz has indicated he won’t be returning to Congress. Sort of feels to me like the report is ugly and more damaging than has been let on.

Otherwise, he literally just won an election to spend two more years. And he suddenly resigns and his new gig doesn’t work…but doesn’t want his old one back that he clearly wanted 2 weeks ago?
